Privacy Policy

TripC LLC (“TripC,” “we,” “us,” or “our”) values your privacy. This Privacy Policy explains how we collect, use, share, and protect your personal information when you use our website, mobile application, and services (collectively, the “Services”). It also outlines your rights and choices regarding your personal information and our compliance with applicable privacy laws such as the General Data Protection Regulation (GDPR) and the California Consumer Privacy Act (CCPA).

  • Account Credentials: Username, password, and any other login information for your account.
  • Profile Information: Information you choose to add to your profile or account (such as a profile photo or bio).
  • Transaction Information: Details related to your transactions on our platform, including bids, purchases, listings (e.g., vehicle details, descriptions, and photos you submit), payment information (such as credit card number or PayPal account), and shipping details.
  • Communications: Copies of communications with us (such as customer support inquiries) or with other users through our platform (for example, messages or comments).

2. Information Collected Automatically

When you interact with our Services, we automatically collect certain information about your device and usage of the site. This information helps us understand how our Services are being used and to improve them. This may include:

  • Usage Data: Information about your activity on our website or app, such as the pages or listings you view, the dates and times of your visits, the features you use, referral URLs, and other actions you take.
  • Device and Technical Data: Information about the device and browser you use to access the Services, including your IP address, device identifiers (e.g., MAC address or mobile device ID), browser type, operating system, and device model.

  • Publicly Available Sources: We may also collect information that is publicly available—for example, if you post a review or comment about TripC on a social media platform and we respond or incorporate that feedback.

  • Provide and Maintain Services: To create and manage your account, facilitate auctions and vehicle listings, process transactions (bids, sales, payments), and generally provide the features and functionality of our platform to you.
  • Communicate with You: To send service-related communications, such as confirmations, receipts, technical notices, updates, security alerts, and support messages. We may also send marketing or promotional communications about new listings, features, or deals, but you can opt out of these at any time.
  • Improve and Personalize Our Services: To understand how users interact with our Services, personalize your experience (such as recommending relevant vehicle listings or tailoring content), and develop new features, products, or services. This includes using analytics to track usage trends and preferences.
  • Ensure Security and Prevent Fraud: To maintain the safety and security of our platform, users, and business. For example, we may use your information to verify accounts, detect and prevent fraud or other unauthorized or illegal activities, debug and fix errors, and enforce our Terms of Service and other policies.
  • Comply with Legal Obligations: To fulfill legal requirements, such as responding to lawful requests by public authorities, complying with applicable laws and regulations (including know-your-customer or tax requirements), or as otherwise required by law or legal process.
  • Other Purposes with Consent: If we intend to use your personal information for a purpose not described above, we will seek your consent where required by law. We may also use your information in other ways that we disclose to you at the time of collection or otherwise with your consent.

We will not use the personal information we collected for materially different, unrelated, or incompatible purposes without providing you notice and, if required, obtaining your consent.

Cookies and Tracking Technologies

We use cookies and similar tracking technologies to collect information as you use our Services, as mentioned above. Cookies are small text files placed on your device that allow us to recognize your browser or device and remember certain information. We use cookies to:

  • Keep you logged in to your account and remember your preferences.
  • Understand and save your settings for future visits.
  • Analyze site traffic and user behavior on our platform to improve functionality.
  • Facilitate advertising or marketing efforts (for example, by delivering content or features that match user profiles or interests), where applicable.

However, note that disabling cookies may affect the functionality of our Services (for example, some features might not work properly). “Do Not Track” Signals: Your browser or device may offer a “Do Not Track” (DNT) option, which allows you to signal your preference regarding tracking by websites. At this time, our Services do not respond to DNT signals. We will continue to monitor developments around DNT browser technology and re-evaluate our practices if necessary.

How We Share Your Information

We do not sell your personal information. However, we may share your personal information with third parties in certain circumstances, as described below. When we share data, we take steps to protect it and limit the information that is disclosed to what is necessary.

  • Service Providers: We share information with third-party service providers who perform services on our behalf to support our operations and the provision of our Services. Examples include payment processors, fraud prevention and security services, web hosting and IT providers, email/message delivery services, and analytics companies that help us understand how users use our Services. These service providers are contractually required to protect your information and use it only for the purposes of providing their services to us.
  • Business Partners and Integrations: If you engage with third-party partners through our Services (for example, an insurance provider, financing company, or shipping partner that you access via our platform), we may share information with those partners as needed to facilitate your chosen service. Such partners should have their own privacy policies to govern their use of your information.
  • Other Users and Public Posts: If you post content in public areas of our platform, such as comments, questions, or vehicle listings, that information will be visible to other users. Similarly, if you participate in an auction, certain information (like your username and bidding activity) may be visible to other participants. Please be mindful of what you choose to share publicly on our platform.
  • Affiliates and Corporate Transactions: We may share your information with our parent company, subsidiaries, joint ventures, or other companies under common control with TripC (collectively, “affiliates”), in which case we will require them to honor this Privacy Policy. Additionally, if TripC is involved in a merger, acquisition, asset sale, financing, or bankruptcy, your information may be transferred to a successor or affiliate as part of that transaction.
  • Legal Compliance and Protection: We may disclose your information if required to do so by law or in the good faith belief that such action is necessary to (i) comply with a legal obligation, subpoena, or court order; (ii) protect and defend the rights, property, or safety of TripC, our users, or others; (iii) investigate or assist in preventing any violation of law or our Terms of Service; or (iv) protect against legal liability.
  • With Your Consent or at Your Direction: We will share your personal information with third parties if you consent to or request such sharing. For instance, if you opt in to a promotion, referral program, or request that we share data with a third-party service, we will do so under the terms of your agreement or consent.

Data Security

We implement reasonable and appropriate security measures to protect the personal information we collect from unauthorized access, disclosure, alteration, and destruction. These measures include technical, administrative, and physical safeguards designed to protect your data. For example, we use encryption (e.g., SSL/TLS) to protect data transmitted to and from our site, and we maintain access controls to our systems.

However, please note that no method of transmission over the Internet or electronic storage is completely secure. While we strive to protect your personal information, we cannot guarantee its absolute security. You should also play a role in protecting your information by keeping your account credentials secure and logging out after using the Services.

Data Retention

We retain your personal information for as long as necessary to fulfill the purposes for which we collected it, unless a longer retention period is required or permitted by law. For example, we will keep your account information while your account is active and for a reasonable period thereafter in case you decide to reactivate the Services. We may also retain certain information for longer periods if necessary to comply with legal obligations, resolve disputes, enforce our agreements, or protect our legal rights.

When we have no ongoing legitimate business need or legal requirement to retain your personal information, we will delete, anonymize, or aggregate it. If deletion is not feasible (for example, because your personal information has been stored in backup archives), we will securely store your personal information and isolate it from further processing until deletion is possible.

Your Rights and Choices

You have certain rights and choices regarding your personal information. These rights may vary based on your location and applicable privacy laws. We are committed to honoring your rights and providing you with control over your information. Key rights include:

  • Access and Portability: You may request access to the personal information we hold about you and obtain a copy of it in a portable format. This allows you to review the information and, in some cases, transfer it to another service.
  • Correction: You have the right to request that we correct or update any inaccurate or incomplete personal information we have about you.
  • Deletion: You can request that we delete your personal information. Note that we may need to retain certain information for legitimate business purposes or to comply with legal obligations (for example, records of transactions you have made, or when laws require us to keep certain data).
  • Objection to Processing: You may object to or ask us to restrict the processing of your personal information in certain circumstances – for example, if you believe we are processing it unlawfully or beyond the scope of what is necessary for the Services.
  • Withdraw Consent: If we are processing your personal information based on your consent, you have the right to withdraw that consent at any time. For instance, you can opt out of marketing emails by using the “unsubscribe” link in those emails or by contacting us directly. Withdrawal of consent will not affect the lawfulness of any processing carried out before you withdraw consent.
  • Opt-Out of Sale or Sharing of Personal Information: Applicable privacy laws (like the CCPA) may give you the right to direct a business that sells personal information to stop selling it. As noted above, TripC does not sell personal information. If in the future we plan to sell personal data or use it for targeted advertising in a way that is considered a “sale” or “sharing” under applicable law, we will provide you with notice and the opportunity to opt out.
  • Non-Discrimination: We will not discriminate against you for exercising any of your privacy rights. For example, we will not deny you services, charge you a different price, or provide a different level of service because you exercised your rights under privacy laws, except to the extent permitted by those laws (such as offering a different price if the difference is reasonably related to the value of your data).

California Residents: If you are a California resident, you have specific rights under the CCPA regarding your personal information, including the right to know what categories of personal information we collect, the purposes for which we use it, the categories of sources from which it is collected, and the categories of third parties with whom we share it. You also have the right to request that we disclose to you the specific pieces of personal information we have collected about you in the last 12 months. Additionally, you may have the right to request information about our disclosures of certain categories of personal information to third parties for direct marketing purposes (per California’s “Shine the Light” law). This Privacy Policy is intended to provide the information required by the CCPA. California residents can exercise their rights as described below in the “Exercising Your Rights” section.

European Economic Area (EEA) and UK Residents: If you are located in the EEA, UK, or a similar jurisdiction with comprehensive data protection laws (like the GDPR), you also have certain rights which overlap with those above. This includes the rights of access, rectification, erasure, restriction of processing, data portability, and objection to processing of your personal data. You also have the right to lodge a complaint with a supervisory data protection authority in your country of residence or place of work if you believe our processing of your personal information violates the law. We process your personal information only when we have a legal basis to do so, such as your consent, to fulfill a contract with you (e.g., our Terms of Service), to comply with legal obligations, or for our legitimate interests (such as improving our Services), taking into account your rights and interests.

Exercising Your Rights

To exercise any of your rights described above or to make any requests regarding your personal information, please contact us using the information provided in the Contact Us section below. We may need to verify your identity before fulfilling certain requests, to ensure that your personal information is not disclosed to someone who does not have the right to receive it. Verification may include confirming information we already have on file or asking for identification.

If you have an account with us, you may also review and update your information by logging into your account settings. For deletion requests, you may need to contact us directly so we can ensure any data in backups or other systems is handled appropriately.

If you authorize someone (an “authorized agent”) to make requests on your behalf, we will need proof that the agent has your permission to act for you. We will respond to your request within the time frame required by law (generally within 30 days for GDPR requests and 45 days for CCPA requests, with the possibility of a reasonable extension). Any disclosures we provide will cover the 12-month period preceding the request, as required by law.

International Data Transfers

TripC is based in the United States, and our Services are primarily operated from the U.S. If you are accessing our Services from outside the United States, please be aware that your information may be transferred to, stored, and processed in the United States or other jurisdictions where our facilities or our service providers are located. These countries may not have the same level of data protection laws as your home country, but we take steps to ensure that appropriate safeguards are in place to protect your personal information in accordance with this Privacy Policy.

For example, if you are in the EEA, UK, or Switzerland, we may rely on mechanisms such as standard contractual clauses or your consent to transfer your data to the U.S. or other countries where applicable.

Children’s Privacy

Our Services are not directed to children under the age of 13, and we do not knowingly collect personal information from anyone under 13. If you are under 13, please do not use our Services or provide any personal information to us. If we learn that we have inadvertently collected personal information from a child under 13, we will delete such information as soon as possible. If you believe we might have any information from a child under 13, please contact us.

For residents of certain jurisdictions, such as California, different age limits may apply under applicable laws (for example, the CCPA defines a “child” as under 16 for certain data-sharing purposes). We will adhere to applicable laws regarding children’s data.

Changes to This Privacy Policy

We may update or modify this Privacy Policy from time to time. If we make material changes, we will notify you by (for example) posting a prominent notice on our website or within the app, and/or by sending you an email notification. The “Effective Date” at the top of this Privacy Policy indicates when the latest revisions were made. We encourage you to review this Privacy Policy periodically to stay informed about how we are protecting your information.

Your continued use of our Services after any changes to this Privacy Policy have become effective will constitute your acceptance of those changes, to the extent permitted by law.
